Terms of sale

Version of October 27, 2026

These general terms and conditions of sale (terms of sale) apply to orders placed on the website pausenuage.fr with:

PAUSE NUAGE, Société par actions simplifiée (SAS) with a share capital of €5 000,00, with its registered office at 16 rue Danielle Mitterrand, 94380 Bonneuil-sur-Marne, registered under number 102 918 158 R.C.S. Créteil, running the café Pause Nuage, 99 rue Monge, 75005 Paris, SIRET 102 918 158 00027, EU VAT number FR91102918158. Email: pause-nuage@outlook.fr.

Hereinafter “Pause Nuage” or “we”.

2.1. These terms govern the distance sale, to consumers, of drinks and food prepared by Pause Nuage and collected at the café on the same day (“Click & Collect”). They do not apply to purchases made directly at the counter. These terms apply only to consumers acting for personal purposes. Purchases made by professionals acting for business purposes are excluded.

2.2. Before paying, you read the terms of sale, available at all times in the footer and from the order summary. By clicking “Order and pay”, you accept them. The applicable version is the one in force on the date of your order; it is stored with the order.

2.3. You declare that you have the capacity to enter into contracts. A minor may order within the limits of the everyday acts allowed by law (French Civil Code, Art. 1148).

3.1. You can order as a guest. No name or email is requested and no order email is sent: keep your personal tracking link and PDF confirmation. Do not share the link, which grants access to the order.

3.2. You may create an account using a verified email and a password. No name, telephone number or postal address is requested. Orders placed while signed in appear in your account for 30 days after pickup. Confirmations and refund notifications are sent by email. Previous guest orders are not automatically linked to an account.

3.3. Pause Nuage may refuse an order in the event of proven fraud or abuse, after informing you.

4.1. The products offered online are those of the menu marked as available for Click & Collect. Products marked “Dine-in only” cannot be ordered online. Products are prepared by our team on the pickup day, except for some desserts such as cookies or banana bread, which may be made the day before; the photographs illustrate the products, whose presentation may vary slightly.

4.2. Allergens. The presence of each of the 14 regulated allergens (Regulation (EU) No 1169/2011, Annex II) is shown on the page of each product and for each option (plant-based milks, syrups, coulis…), before ordering. It is recalled in the summary and at the counter at pickup. If you have an allergy or intolerance, check this information and, if in any doubt, contact us before ordering.

4.3. Some options carry an extra charge, shown next to the option.

5.1. Prices are shown in euros, including all taxes (VAT at the rate applicable to each product). They include no delivery, service or payment fees: the price shown is the price paid.

5.2. The applicable price is the one shown in the summary at the time of the order. The price of each chosen option is included in the price of the line.

6.1. Orders are placed online, in the following steps:

  1. choice of the products and options, added to the cart;
  2. choice of a pickup slot, on the same day, during the café’s opening hours, at least 15 minutes after the time of the order and within the places available in each slot;
  3. summary: products, options, quantities, prices including VAT, total and slot. At this stage you can change your cart and correct any error;
  4. click on the “Order and pay” button, which takes you to the secure payment page of our provider SumUp;
  5. payment.

6.2. Your slot is held for 30 minutes to give you time to pay. Without payment within that time, the order expires and the slot is released.

6.3. The contract is concluded when payment is accepted. The confirmation and tracking pages summarise the order. Signed-in customers receive a confirmation email at their verified address and can find the order in their account. Pause Nuage sends no email for guest orders: keep the tracking link and downloadable PDF containing the order and accepted terms. Any receipts sent by SumUp depend on its own service.

6.4. Pause Nuage may refuse an order in the event of an earlier unresolved dispute with the customer or of suspected fraud. Click & Collect may be suspended temporarily (busy period, exceptional closure): no order can then be placed.

7.1. Payment is made online by bank card or digital wallet offered on the SumUp checkout page, on the secure page of SUMUP LIMITED (an Irish company, company no. 505893, Block 8, Harcourt Centre, Charlotte Way, Dublin 2, D02 A9N9, Ireland, electronic money institution authorised by the Central Bank of Ireland under reference C195030, French SIREN 852 307 487). Payment may require strong authentication (3-D Secure). The amount is charged at the time of the order.

7.2. Pause Nuage never has access to your bank card details.

7.3. If your payment is declined, you can try again on the same payment page. Without an accepted payment within 30 minutes, or before the chosen pickup time, the order expires and no amount is charged. No email is sent in that case. The order follows the retention rules stated in the privacy policy.

8.1. The order is collected at the counter of the café Pause Nuage, 99 rue Monge, 75005 Paris, on the same day, from the chosen slot, by you or someone you choose, on presentation of the order number shown on the tracking page. The slot is the time from which the order can be collected: when the café is busy, preparing it may take a few more minutes. We then prepare your order as soon as possible. A short preparation delay does not in itself mean that the order cannot be fulfilled. Your rights in the event of delay or non-fulfilment still apply (Article 9.4).

8.2. Check your order at pickup. The risk of loss or damage to the products passes to you when you take possession of them (French Consumer Code L216-4).

8.3. Order not collected. Your order is kept for one hour after the start of the chosen slot. Hot drinks may cool while waiting. After that time, the order is considered abandoned and the perishable products are neither carried over nor refunded solely because they were not collected; they may be given to another customer or disposed of to avoid waste. This rule is subject to the customer’s mandatory legal rights, including in cases of force majeure, non-conformity or inability to fulfil the order attributable to Pause Nuage (Articles 9 and 11).

9.1. By you. While your order is awaiting payment, you can cancel it from its tracking page: nothing is charged and the slot is released. After payment, immediate cancellation by the customer is no longer available. A discretionary cancellation or refund request requires the café’s approval, without affecting the statutory rights described in Articles 9.4 and 11. For an order placed with an account, you can submit a request from your account while the order is paid, not yet collected and has no refund in progress. The request leaves the order and preparation active; approval by the café records cancellation and starts the refund. Declining the request leaves the order unchanged. For guest orders, collected orders or any other complaint, contact pause-nuage@outlook.fr with your order reference. Availability of the form does not limit your statutory rights.

9.2. By Pause Nuage. If we cannot fulfil your order (including unavailability after payment, exceptional closure or a technical incident), we cancel it and refund the sums paid, at no cost. Cancellation before payment requires no refund because no payment was collected. Your rights in the event of delay or non-fulfilment are described in Article 9.4.

9.3. Refund processing and tracking. Refunds issued through the site are processed by SumUp to the original payment method. Cancelling a paid order records a refund request; it does not mean the refund is already complete. A processing incident leaves the refund pending and triggers automatic retries. The order page shows its status. For account orders, separate emails announce cancellation and the refund confirmed by the payment provider. Guest orders receive no email: keep your tracking link. Your bank determines when the credit appears in your account. These technical arrangements do not extend applicable statutory deadlines.

9.4. Your rights in the event of delay or non-fulfilment. Articles L216-6 and L216-7 of the French Consumer Code remain applicable. You may terminate the contract in writing if the order is not supplied after you have formally requested fulfilment within a reasonable additional period. Termination may be immediate if fulfilment is refused or manifestly impossible, or if the agreed date or period was an essential condition of the contract under the statutory conditions. When the contract is terminated on these grounds, we refund all sums paid no later than fourteen days after notice of termination. Send your request to pause-nuage@outlook.fr with your order reference.

Under Article L221-28, 4° of the French Consumer Code, the right of withdrawal does not apply to Click & Collect orders, which concern drinks and food prepared for pickup on the same day, liable to deteriorate or expire rapidly. You are informed of this before ordering, in the summary and on the post-payment confirmation page. Account orders receive a confirmation email; guests keep their PDF.

This exclusion of the right of withdrawal does not limit your statutory guarantees or the refunds described in Articles 9 and 11.

The absence of a right of withdrawal does not mean that refunds are impossible: cancellation by the café, an approved request or an applicable statutory right may result in a refund.

11.1. If a product is missing, does not match your order or is defective, preferably report it at the counter at pickup: we replace or refund it. You can also write to us at pause-nuage@outlook.fr with your order number. This quick report makes handling easier, but does not deprive you of any of your legal guarantees.

11.2. You benefit from the legal guarantee of conformity (French Consumer Code L217-3 et seq.) and the legal guarantee against hidden defects (French Civil Code, Art. 1641 to 1649).

The buyer is entitled to a period of two years from the delivery of the goods to obtain the implementation of the legal guarantee of conformity in the event of a lack of conformity. During this period, the consumer is only required to establish the existence of the lack of conformity and not the date of its appearance.

The legal guarantee of conformity implies an obligation for the professional, where applicable, to provide all updates necessary to maintain the conformity of the goods.

The legal guarantee of conformity gives the consumer the right to have the goods repaired or replaced within thirty days of their request, free of charge and without major inconvenience to them.

If the goods are repaired under the legal guarantee of conformity, the consumer benefits from a six-month extension of the initial guarantee.

If the consumer requests the repair of the goods, but the seller imposes a replacement, the legal guarantee of conformity is renewed for a period of two years from the date of replacement of the goods.

The consumer may obtain a reduction in the purchase price by keeping the goods or terminate the contract by being fully reimbursed against return of the goods, if:

1° The professional refuses to repair or replace the goods;

2° The repair or replacement of the goods takes place after a period of thirty days;

3° The repair or replacement of the goods causes a major inconvenience to the consumer, in particular when the consumer definitively bears the costs of taking back or removing the non-conforming goods, or if they bear the costs of installing the repaired or replacement goods;

4° The lack of conformity of the goods persists despite the seller's unsuccessful attempt to bring them into conformity.

The consumer is also entitled to a reduction in the price of the goods or to the rescission of the contract when the lack of conformity is so serious that it justifies the reduction in price or the rescission of the contract being immediate. The consumer is then not required to request the repair or replacement of the goods beforehand.

The consumer is not entitled to rescind the sale if the lack of conformity is minor.

Any period of immobilization of the goods for repair or replacement suspends the remaining guarantee until the delivery of the repaired goods.

The rights mentioned above result from the application of Articles L. 217-1 to L. 217-32 of the French Consumer Code.

A seller who obstructs the implementation of the legal guarantee of conformity in bad faith faces a civil fine of up to 300,000 euros, which may be increased up to 10% of the average annual turnover (Article L. 242-22-1 of the French Consumer Code).

The consumer also benefits from the legal guarantee against hidden defects pursuant to Articles 1641 to 1649 of the French Civil Code, for a period of two years from the discovery of the defect. This guarantee entitles the consumer to a price reduction if the goods are kept or to a full refund against return of the goods.

12.1. Pause Nuage is responsible for the proper performance of the order, under the conditions provided by law. It cannot be held liable in case of force majeure (French Civil Code, Art. 1218) or of an act attributable to the customer, in particular if the customer disregarded the allergen information made available to them.

12.2. The site may be temporarily unavailable for maintenance or in case of a technical incident. An order already paid is then fulfilled or refunded in full.

The data needed for the order is processed by Pause Nuage to fulfil it, as described in the privacy policy, which also sets out your rights and how to exercise them. For an order without an account, we store neither your name nor your email address, and our payment provider SumUp passes us neither.

The Pause Nuage name and logo, the texts and the photographs of the site are protected. Reproducing them without written permission is prohibited.

15.1. Orders are kept for 30 days after the pickup date, then deleted; accounting data is kept for 10 years, without your name or email.

15.2. The amount of each order placed online is capped at €119.99 including VAT.

15.3. The data recorded by our systems and by SumUp (date and content of the order, version of the terms of sale accepted, payment) is kept under reasonable security conditions and may serve as evidence of the order and its payment.

For any question or complaint: by email at pause-nuage@outlook.fr, by post or at the counter: Pause Nuage, 99 rue Monge, 75005 Paris, during the opening hours shown on the site.

In the event of a dispute, send us a written complaint at pause-nuage@outlook.fr or by post to the café, stating your order number. We will look for an amicable solution with you.

These terms of sale are governed by French law. They are written in French; this English translation is provided for information only, and in the event of any difference, the French version prevails. Failing an amicable agreement, the dispute is brought before the competent court under the ordinary rules; you may in particular refer it to the court of the place where you lived at the time of the order (French Consumer Code R631-3).

Pause Nuage may change the terms of sale at any time. The version applicable to an order is the one accepted at the time of that order. Each version is dated and remains available at pausenuage.fr/en/cgv/YYYY-MM-DD (for example, the version of 25 October 2026: pausenuage.fr/en/cgv/2026-10-25).
